Terms of Service

1. The service

Xonaplay is a software-as-a-service (SaaS) platform for hosting and distributing video. You upload a video file and our engine transcodes it into multiple resolutions (360p, 480p, 720p and 1080p) in adaptive HLS format, with AES-128 encryption on delivery. We give you an embeddable player and a link to share your content.

You can try Xonaplay without an account (guest mode). A video uploaded as a guest is automatically deleted after 24 hours, unless you register and keep it by associating it with an account.

We reserve the right to modify, suspend, or discontinue features of the service. When a change is material and affects you, we will make a reasonable effort to notify you in advance.

2. Your account

To use Xonaplay with persistence you need an account. You are responsible for the information you provide, for keeping your credentials confidential, and for all activity that occurs under your account.

You must be of legal age in your jurisdiction to create an account. We do not provide the service to minors.

• Legal age: you represent that you are of the legal age required to enter into this agreement.
• One account: each person or entity may keep a single account, unless we expressly authorize otherwise.
• No plan circumvention: you may not create multiple accounts, split workloads across accounts, or use other methods to evade your plan's limits, quotas, or pricing.
• Security: notify us immediately at [email protected] if you detect unauthorized use of your account.

3. Permitted content

You may only upload, store, and distribute content for which you hold all necessary rights, licenses, and permissions. You are solely responsible for the content you upload and for its use through Xonaplay.

It is strictly prohibited to upload or distribute:

• Child sexual abuse material (CSAM) or any content that exploits or endangers minors.
• Content that infringes copyright, trademarks, publicity rights, or other third-party rights.
• Malware, viruses, malicious code, or files designed to harm systems or bypass security controls.
• Content that promotes hatred, violence, harassment, or discrimination against people or groups.
• Any content that is unlawful under applicable law.

We may remove content, disable links, or suspend accounts without prior notice when we detect a violation of these Terms, particularly in the case of CSAM or clearly unlawful material, which we may also report to the competent authorities.

4. Plans and payments

Xonaplay offers a free Starter plan and paid plans: Pro (USD 10/month) and Enterprise (USD 30/month). The features, quotas, and limits of each plan are described on the pricing page.

Paid subscriptions are billed in advance and renew automatically at the end of each (monthly) period, at the then-current price, until you cancel. By subscribing to a paid plan, you authorize recurring charges to your registered payment method.

• Automatic renewal: your plan renews on its own unless you cancel before the current period ends.
• Self-serve cancellation: you can cancel anytime from your account dashboard; the plan stays active until the end of the period already paid for.
• Refunds: unless applicable law provides otherwise, payments are non-refundable [refund window to be confirmed].
• Taxes: prices do not include taxes, which will be added where applicable.
• Non-payment: we may suspend or downgrade your account to the free plan if a charge fails and is not resolved.

5. Acceptable use

You agree to use Xonaplay lawfully and not to harm the integrity of the service or the experience of other users.

• Do not use the service to distribute spam, fraudulent schemes, or deceptive content.
• Do not attempt to gain unauthorized access to systems, data, or other users' accounts.
• Do not overload, scan, or interfere with the infrastructure, the transcoding engine, or CDN delivery.
• Do not reverse engineer, mass scrape, or resell the service without authorization.
• Do not bypass AES-128 encryption, upload tokens, or other security mechanisms.

6. Intellectual property

You retain all intellectual property rights in the content you upload. Xonaplay claims no ownership of your videos.

To provide the service, you grant us a worldwide, non-exclusive, royalty-free license, limited to storing, transcoding, encrypting, copying for backup purposes, and distributing your content through our infrastructure and CDN, solely to operate and improve the service as you instruct (for example, when you publish or share a video). This license ends when you delete the content, except for residual copies in backups that are purged in the normal course of operation.

The software, the Xonaplay brand, the player, the design, and all service materials are the property of Xonaplay or its licensors, and no rights in them are transferred to you.

7. Service availability

We make reasonable efforts to keep Xonaplay available, but the service is provided as is and as available. We do not guarantee that it will be uninterrupted, error-free, or that transcoding, storage, or delivery will always be available.

We may perform scheduled or emergency maintenance and apply reasonable technical limits. Remember that content uploaded in guest mode is deleted after 24 hours.

8. Limitation of liability

To the maximum extent permitted by applicable law, Xonaplay and Xonaplay will not be liable for indirect, incidental, special, punitive, or consequential damages, nor for loss of data, content, revenue, or profits arising from the use of or inability to use the service.

In any event, our total aggregate liability is limited to the amount you paid for the service in the twelve (12) months preceding the event giving rise to the claim. You are responsible for keeping your own copies of any content you consider important.

9. Copyright and DMCA

We respect intellectual property rights and respond to infringement notices in accordance with our Copyright Policy. If you believe content hosted on Xonaplay infringes your rights, you can send us a notice at [email protected].

We handle notices and counter-notices under the procedure described in that policy and may take down infringing content and terminate the accounts of repeat infringers. The designated agent is [DMCA agent to be confirmed].

10. Governing law

These Terms are governed by the laws of [jurisdiction to be confirmed], without giving effect to its conflict-of-laws rules. Any dispute will be submitted to the competent courts of [jurisdiction to be confirmed].

If any provision of these Terms is found invalid or unenforceable, the remainder will continue in full force and effect.
